Legal Speeches and Their Role in the Primacy of the Socialist View Over the Individualist

Abstract
The theory of legal speeches is one of the innovations of Imam Khomeini (r). This theory is in contrast to the personal speeches of the legislator towards those Divinely obligated; which are general and universal for all obligated people in society and are expressed in the form of real propositions. The issue of the present research is to analyze the non-dissolution or dissolution of the aforementioned propositions from the perspective of obligated individuals, the fruit of which has a direct impact on the primacy of socialist security over individualism. The famous fundamentalists considered legal speech to be divisible into personal speeches equal to the number of each person addressed, but Imam Khomeini (r) considered it as being indivisible. The authors studied the effect of the theory in the primacy of the socialist security approach over the individualist using a descriptive-analytical method and reached the following conclusions: 1. Political security can be considered at both individual and national levels. 2. The theory of legal speeches proposed by Imam Khomeini (r) has not been put in one place, but has been presented in various discussions and in a scattered manner. Sometimes he presents it in brief science and considers it as a solution to the problems in the field, and sometimes he presents it in the preliminary plan for discussing the opposite. 3. The importance of the macro interests of society and the promotion and maintenance of social security takes precedence over individual security. Although when referring to jurisprudential sources, much emphasis has been placed on the independence and sanctity of individual rights such as the right to freedom in speech, the preservation of livelihood, the preservation of human dignity, and the right to property, according to the theory of legal speeches, in the Islamic government, attention should be paid to the priority of social security in determining macro strategies and drafting laws.
